The October 17, 2005 enacting of the "Bankruptcy Abuse Prevention and Consumer Protection Act of 2005" dramatically changed the former bankruptcy laws. Among the changes are two provisions that require financial counseling and education for consumers.
The first is a requirement that, before filing for bankruptcy, consumers receive a briefing on their alternatives to bankruptcy with a U.S. Trustee approved* credit counseling service. The second provision requires that a consumer complete an instructional course concerning personal financial management from a U.S. Trustee approved* agency before receiving a bankruptcy discharge.
On December 21, 2005, Debt Reduction Services received approval from the Executive Office of the U.S. Trustees to begin providing the pre-Bankruptcy Credit Counseling Briefing. On April 13, 2006, we received approval from the same office to begin providing the post-Bankruptcy Personal Financial Management course.
